ST. PETE: Teen Sentenced to 27 Years in Prison for Rape at The Table

A Tampa Bay area teenager, convicted of a violent rape, has been sentenced to 27 years in the Florida State prison system.

Jose Walle, 15, was one of three men accused in a string of attacks throughout the Bay area in the summer of 2008.

He and two others are facing charges in connection with an Armed Robbery and Armed Sexual Battery at The Table in downtown St. Petersburg. Investigators said the trio also attacked women in Gibsonton and Apollo Beach.

Investigators said that, while Walle himself did not commit any of the rapes, he helped make the crimes happen. In one case, investigators said he pointed a gun at a duct-taped kitchen worker while one of the other, Rigoberto Moron Martinez, raped another employee on the kitchen floor.

According to the St. Pete Times, Pinellas-Pasco Circuit Judge Joseph A. Bulone remarked at Walle's sentencing that: "Quite frankly, the facts of this case are amazingly aggravated; they are very, very serious."

MIAMI: Cab Driver Stiffed on $3,000 Fare from Miami to Memphis

A South Florida cab driver was tricked into making a 20-hour trip from Miami, Florida to Western Tennessee over the weekend. And he ended up getting stiffed, not getting a penny for his efforts, according to CBS4's Stephen Stock.

Lucilo Perez.jpg

From 7:00 at night until 4:30 in the morning, 6 days a week, for 29 years, Jean Desir has driven a taxi on the streets of Miami.

Despite two Robberies, one at gunpoint, and countless riders who've stiffed him on fares, this past year has been toughest of all economically.

"This year has been really really hard," the 54 year-old said, "really hard."

That's what makes the story of Desir's fellow taxi-driver so tough to swallow this holiday season.

Police say Miami resident Luciolo Perez convinced a cabbie from Flamingo Taxis to drive him to Memphis, Tennessee. That's a 20-hour cab ride to the middle of the country.

Then police say Perez stiffed the driver of $3,000 in cab fare, plus expenses such as gas and meals, which the cabbie paid with his own credit card.

CBS4 spoke by phone with the cab driver, who drove his taxi halfway across the country and back.

His name is Lelis Almeira.

Almeira refused CBS4's request for an on-camera interview, saying he was tired, frustrated and angry and "I just want to put this incident behind me."

Now, in addition to trying to find $3,000 in cab fare, Perez must find enough money to bond out of jail on his Grand Theft charge.

LOS ANGELES, CA: Erin Andrews Seeks Harsh Sentence Against Video Stalker

A disgraced Illinois insurance executive pleaded guilty Tuesday, in Los Angeles, California, to secretly shooting nude videos of ESPN reporter Erin Andrews, who repeatedly called her stalker a "sexual predator" and said she hopes he "never sees the light of day," says The Associated Press in a recent USA Today article.

erin-andrews-espn.jpg

Michael David Barrett pleaded guilty to Interstate Stalking after Andrews urged the judge to give him a harsh sentence and not allow him out on bail.

"His actions have had a devastating impact on me and family," said Andrews, who attended the hearing with her father and attorney.

She said she is constantly reminded that Barrett's videos appeared online and subjected her to cruel taunts from sports fans while working as a sideline reporter.

"I don't know him," she said. "I haven't met him. I hope he never sees the light of day."

U.S. District Judge Manuel Real allowed Barrett to remain free pending sentencing on Feb. 22.

According to a plea deal filed last week, Federal prosecutors and Barrett agreed to a 27-month prison sentence. But the judge will decide how long he serves and how much restitution he will have to pay Andrews.

Barrett has admitted renting hotel rooms next to Andrews three (3) times and shooting two (2) videos of her while she was naked. He was accused of posting the videos online and trying to sell them to the Los Angeles-based celebrity gossip site TMZ this year.

Andrews was poised as she addressed the court. She looked down at times as Real read the allegations against Barrett, which included details of him traveling to follow Andrews. She shook her head when Real read about Barrett buying information about Andrews online, and dabbed tears after Barrett entered his guilty plea.

Barrett stood at a podium for the nearly ten (10) minutes it took to read the allegations against him. He repeatedly answered, "Yes, your Honor" when Real asked him to waive his rights and confirm the truthfulness of the allegations.

Federal Prosecutors in Los Angeles have agreed not to pursue further charges against Barrett. However, he could face criminal action in other states stemming from other videos he allegedly shot of unsuspecting nude women through peepholes.

ST. PETE: Woman Arrested for Domestic Battery by Beer?

Yes. You read correctly. She was charged with Domestic Battery by beer.

Melva Ann Wixon, 49, was arrested Tuesday night on a Domestic Battery charge after a wet incident at her apartment.

Here's what the po-po have to say:

Wixon got home about 7:00 p.m. at an apartment she shares with her boyfriend, Eric Hartman. She had been drinking at a bar. He had been sleeping.

She was angry at him because he plans to move to Ohio. So she poured beer on him. This woke him up.

Displeased by her action, Hartman called the police.

Wixon was still at the Pinellas County Jail Wednesday morning awaiting her Advisory/ First Appearance before a Judge.

Unfortunately, the brand of beer she wielded was not included in the incident report. Let's only hope it wasn't something good like Guinness or Newcastle!!

PINELLAS COUNTY: PCJ Inmate Walks out of Jail on Fake Paperwork

An inmate at the Pinellas County jail is accused of forging paperwork to get out of jail.

According to Bay News 9's partner paper, the St. Petersburg Times, Nydeed Nashaddai managed to fake a letter that got him out of jail. He was in jail on fifteen (15) counts of Uttering Forged Bills, Drafts, Checks or Notes, six (6) counts of Grand Theft and four (4) counts of Fraudulent Use of Personal ID Info.

Nashaddai's release only lasted about a day. When the victim was notified about the release, he called the Pinellas County State Attorney's Office, who then found out that Nashaddai was not supposed to be let out of jail.

Nashaddai was "re-arrested" the same day. He now faces an additional charge of Escape and remains in the Pinellas County Jail without a bond. It remains to be seen if he can walk his way out of jail again.

NEW PORT RICHEY: You the Taxpayer Will Be Paying for Neo-Nazi's Tattoos To Be Covered By a Court Appointed Cosmetologist Each and Every Day of His Upcoming Murder Trial

Taxpayers will foot the bill for a makeup artist to cover up some potentially offensive tattoos on the face and neck of a neo-Nazi during his First Degree Murder trial scheduled to begin next week.

Ditullio.jpg

Attorneys for John Allen Ditullio Jr. aren't taking any chances when it comes to the 23-year-old's homemade tattoos inked since his arrest three (3) years ago.

"This on the side says 'f--- you' (and) is very offensive regardless of whether he had it (at the time of the crime) or didn't have it," defense attorney Bjorn Brunvand argued in a Pasco County courtroom Friday.

Circuit Judge Michael Andrews said he would allow a licensed cosmetologist to be brought in an hour before each day's proceedings to cover up Ditullio's tattoos. Ditullio is charged with the March 23, 2006, fatal stabbing of 17-year-old Kristopher King.

In a previous hearing in Pinellas County, Chief Judge Thomas McGrady authorized spending up to $150 per day for the cosmetologist, but only if Andrews -- the trial judge -- ruled that it was necessary, court spokesman Ron Stuart said.

Brunvand told the St. Pete Times that Ditullio, while in jail, acquired a tattoo that looks like a barbed wire going down one side of his face. He also got a swastika on his neck, too high up to be covered by a shirt collar.

The problem, Brunvand said, is that the average person on a jury might be "either offended or intimidated and maybe frightened by these tattoos." Brunvand is concerned the tattoos -- not the evidence -- might lead jurors to suspect Ditullio is guilty.

In other words, the tattoos could prejudice a jury, even though they "have nothing to do with the facts of the case," Brunvand told the St. Pete Times.

Brunvand argued in court Friday that the neo-Nazi group Ditullio was affiliated with wore uniforms but "that doesn't mean you have to wear it in court."

Ditullio, who attended the court hearing, wore a red jail uniform issued to "high risk" inmates. Dituillo is classified as such because he once was caught trying to escape.

For more information on that foiled "Shawshank"-styled attempt to escape, check out this previous story from Bay News 9.

The tattoos are in black ink. So that begs the question: "How did Dutullio, who was never free on bail, get them?"

Sheriff's officials say inmates have many ways to tattoo themselves in jail. Sometimes they sharpen a staple or a paper clip on concrete and dip it in ink from a ballpoint pen.

"There are a lot of things you can put in your body to make a tattoo," said Pasco sheriff's spokesman Kevin Doll. "If we find them, we confiscate them."

Assistant State Attorney Mike Halkitis said the makeup should be limited to tattoos obtained after Ditullio's arrest in the 2006 stabbing. He argued that prejudice wasn't a good enough reason to cover all of Ditullio's tattoos.

"Everything he did that day was prejudicial," he said.

The tattoos that Ditullio had before his 2006 arrest -- including small crosses under both eyes -- will not be covered up. Halikitis also asked that tattoos on Ditullio's knuckles be left exposed because photos of scratches on his hands are being used as evidence.

Ditullio faces charges of First-Degree Murder and Attempted Murder. Deputies say he put on a gas mask, broke into neighbor Patricia Wells' home in west Pasco County, stabbed her and killed 17-year-old Kristopher King, who was visiting Wells.

The state is seeking the death penalty. Jury selection is to begin Monday.

OLDSMAR: Pinellas County Teen Arrested for Attacking Snoring Father

An Oldsmar teenager has been charged with assaulting his father, reportedly because the man was snoring too loudly.

The Pinellas County Sheriff's Office reports that 18-year-old Dylan T. Watson first threw a magazine at his father, who was sleeping on a living room couch Tuesday evening.

When that didn't work, deputies say Watson pushed his father onto the floor and punched him in the face.

The father was checked out at a nearby hospital as a precaution.

Watson was arrested and charged with Domestic Battery. He was released from jail Wednesday.

ST. PETERSBURG: DUI Charge For Lady Who Crashed Into Snell Island Home

A woman who drove her car into her neighbor's house was charged with Driving Under the Influence (DUI) yesterday.

Gail Ann Kay, 54, was driving her 2008 Jeep SUV when she crashed through a house wall at 9:36 p.m. Wednesday, according to the St. Petersburg Police Department. She left a 4-foot square hole in the house at 134 Aranda Street N.E. Fortunately, no one was injured.

Gail Kay.jpg

Kay tried to drive away, but a witness saw her car and called the police (who pulled her over a short time later). To no one's surprise, the front of her car appeared damaged (I'm guessing with a nice paint transfer off of the house that she drove into).

Kay refused a Breathalyzer test as well as standard "field-sobriety tests." However, the St. Pete Police Department indicated in their report that she had "slurred speech, a blank expression, and bloodshot and watery eyes" (I feel like I've read that before.... oh yeah, that's what every DUI police report says).

Kay is facing charges of Leaving the Scene of an Accident Involving Property Damage and Driving Under the Influence.
